W4 Games - Consoles Privacy Policy

This document sets forth the privacy policy (the “W4 Consoles Privacy Policy”) of W4 Games US Inc. and its subsidiaries (such entities collectively, “W4 Games”) regarding its W4 Consoles service (“W4 Consoles”). Your privacy is important to us, and we are committed to protecting it. 

This Privacy Policy:

● affirms our commitments to protect your private information

● sets forth the information that we collect from people who use W4 Consoles and how we protect it; and

● explains how you can contact us if you have questions or concerns.

This Privacy Policy should be read together with the W4 Games Privacy Policy, a copy of which can be found on the W4 Games website or from our Data Protection Officer, whose contact information is set forth in Section 9 of this Privacy Policy.  Persons who also use our W4 Cloud service (“W4 Cloud”) in conjunction with W4 Consoles should also carefully read our W4 Cloud Privacy Policy, a copy of which can be found on the W4 Games website or from our Data Protection Officer.  

Persons who use W4 Consoles sign contracts and receive documentation that set forth legal rights and obligations and important information regarding W4 Console (the “W4 Consoles Materials”).  The W4 Consoles Materials should be read carefully before using W4 Consoles.

Each section of the W4 Consoles Privacy Policy includes a brief summary of that section of the Privacy Policy.

1. W4 Consoles Overview

This Section sets forth an overview of W4 Consoles and where you can find more detailed information about it.

W4 Consoles is a service that allows people to port their games to the console of such console manufacturers and to such versions of those consoles as may be legally permissible for W4 Games from time to time (the “Approved Consoles”).

As of the date of the W4 Consoles Privacy Policy, the Approved Consoles are:

  • Xbox Series X|S          
  • Nintendo Switch

Technical information about W4 Consoles can be found here on the W4 Console GitHub portal, a link to which is provided to W4 Consoles users who participate in the W4 Games Early Access Program, the W4 Consoles Beta Program or who otherwise purchase or are authorized to use the product.      

2. Information We Collect During the W4 Consoles Marketing Process and How We Protect It

This Section sets forth a brief summary of the information that we may collect during the W4 Consoles marketing and sales process and how we protect it. 

We may market W4 Consoles across multiple channels from time (such activity through such channels from time to time, the “W4 Consoles Marketing Process”), including through:

  • the W4 Games website and blog posts contained on that website;
  • our CRM platform on Odoo (the “CRM Platform”);
  • communication channels that we establish in our Early Access Program or our W4 Consoles Beta  Program;
  • social media, such as Linkedin or Twitter;
  • conferences and other industry events;
  • in-person contacts with members of our team or third parties that we may work with.

Information that we may collect during the W4 Consoles Marketing Process includes, but is not limited to:

  • your name;
  • your contact information; 
  • information about your company, including the number of developers that are employed by your company;
  • information about your company’s game; and
  • information about your porting service needs.

The protections regarding the information we collect during the W4 Consoles Marketing Process are set forth in the W4 Games Privacy Policy, a copy of which is available on W4 Games website or available from the firm’s Data Protection Officer. 

3. Information We Collect During the W4 Console Sales Process and How We Protect It

This Section sets forth a summary of information we collect during the W4 Consoles sales process and how we protect it.

Our primary sales channel for W4 Consoles is our CRM Portal which is on Odoo.  The information that we collect during that process and how we protect it is set forth in the W4 Games Privacy Policy.

On the CRM Portal we also collect information specifically related to W4 Consoles which is relevant to the determination of relevant pricing plan, including the number of developers in a company that wishes to use the W4 Console service and their GitHub ID names.

For persons that contract enterprise services, information that is collected can vary based on the type of customer and the service needed.  To provide additional protection to customers of our enterprise services, we offer the possibility of signing an NDA.

4. Information We Collect During the Onboarding Process

This Section discusses information that we collect during the onboarding process and how we protect it.

Applicants for our Early Access Program and our W4 Consoles Beta Program must provide information that we request on a form.  This includes information about:

  • the applicant’s name
  • the applicant’s title
  • the applicant’s email
  • the company’s full legal name
  • project name
  • project description
  • project team size
  • project total budget
  • publisher’s name
  • estimated product launch date
  • the version of Godot currently being used
  • console port access that is requested
  • if NDAs have been signed with respect to consoles for which access is requested
  • console functionality that is requested
  • Godot features that are currently used in connection the project 
  • GitHub team member name, user name and email
  • applicant’s email address
  • applicant GitHub addresses.

Further information that we collect is set forth in our onboarding guides which are sent to successful applicants in our Early Access Program or our W4 Consoles Beta Program.

5. Information We Collect During the Service Process and How We Protect It

This Section describes information that we collect during the onboarding process and how we protect it. 

We provide different levels of service to W4 Console customers.  These levels of service are set forth in our Early Access Program or W4 Consoles Beta Program materials or in our Terms and Conditions. Information that we collect during the service process for enterprise clients is set forth in contracts that we may sign with such clients from time to time.

For Early Access Program or W4 Consoles Beta Program participants, we collect information that you may provide to us during the course of service, such as:

  • additional information that you may provide regarding your game
  • feedback that you may provide to us regarding the Early Access Program, the W4 Consoles Beta  Program, W4 Consoles or the services we provide.

For W4 Consoles Beta Program participants, we collect additional information regarding the status of application to receive console manufacturer certification.

For enterprise clients, the information we collect depends on the specific services requested by the client.  The information we collect and how we protect it is set forth in contracts we sign with our enterprise clients.

6. Information That We Do Not Protect

This Section describes information that we do not protect.

In order to port to consoles, console manufacturers may request, either directly to customers or directly through us, information about the games of individuals or companies that wish to use W4 Consoles. These console manufacturers may store the information that we collect.  W4 Games has no responsibility for information that is stored by console manufacturers.   Accordingly, prior to contracting W4 Consoles for a particular console manufacturer, potential customers should carefully review the privacy policy for such console manufacturer and make sure that they are willing to accept its terms and conditions.

Users of our W4 Console have the right, at any time, to ask:

- if we have shared any information about a particular client with a console manufacturer;

- the information that was shared; and

- when that information was shared.

7. Changes to Our Privacy Policy

In simple terms, this Section sets forth our right to make changes to our W4 Consoles Privacy Policy and how we will inform you if we do make changes.

We reserve the right to change this W4 Consoles Privacy Policy at any time. In the event that we make material changes to this W4 Consoles Privacy Policy, they will be re-posted in the "Privacy" section of our website with the date the modifications were made indicated at the top of the page.   When we make a material change to the W4 Consoles Privacy Policy, we will post notice of the change on our website.

Therefore, please check our website and review this W4 Consoles Privacy Policy from time to time so that you are aware when any changes are made to it. Your continued use of W4 Consoles after such change(s) constitutes your acceptance of any such change(s), and if you do not accept any changes, you may choose not to use W4 Consoles or opt out by sending us appropriate notice. 8.  Legal Disclaimer

This Section sets forth certain legal disclaimers regarding our W4 Consoles Privacy Policy and your rights.

Our W4 Consoles service is provided as is, and we do not represent or warrant that W4 Consoles will be available at all times, or that your use of W4 Consoles will be uninterrupted or error-free. We are not responsible for your ability to access W4 Consoles or matters beyond our control. This W4 Consoles Privacy Policy is governed by the laws of the State of New York.  Any dispute arising from the use of the Services shall be submitted to the competent courts of New York  for resolution.
