W4 Games - Cloud Privacy Policy

This document sets forth the privacy policy (the “W4 Cloud Privacy Policy”) of W4 Games US Inc. and its subsidiaries (such entities collectively, “W4 Games”) regarding its W4 Cloud service (“W4 Cloud”). Your privacy is important to us, and we are committed to protecting it. 

This Privacy Policy:

● affirms our commitments to protect your private information

● sets forth the information that we collect from people who use W4 Cloud and how we protect it; and

● explains how you can contact us if you have questions or concerns.

This Privacy Policy should be read together with the W4 Games Privacy Policy, a copy of which can be found on the W4 Games website or from our Data Protection Officer, whose contact information is set forth in Section 9 of this Privacy Policy.  Persons who also use our W4 Consoles service (“W4 Consoles”) in conjunction with W4 Cloud should also carefully read our W4 Consoles Privacy Policy, a copy of which can be found on the W4 Games website or from our Data Protection Officer.  

Persons who use W4 Cloud sign contracts and receive documentation that set forth legal rights and obligations and important information regarding W4 Cloud (the “W4 Cloud Materials”).  Further, companies or individuals who contribute to our W4 Cloud product through the open beta program must also sign either Individual Contributor License Agreements or Corporate Contributor License Agreements with us. The W4 Cloud Materials and the relevant Contributor License Agreement for persons or entities participating in our open beta program should be read carefully before using W4 Cloud.

Each section of the W4 Cloud Privacy Policy includes a brief summary of that section of the Privacy Policy.

1. W4 Cloud Overview

This Section sets forth an overview of W4 Cloud and where you can find more detailed information about it.

W4 Cloud  is a service that gives video games developers the opportunity to integrate multiplayer game functionality into their video games. 

General information about W4 Cloud can be found on the W4 Games website, which is found here Products – W4 Games     

Technical information about W4 Cloud can be found on the W4 Cloud GitHub portal, a link to which is provided to W4 Cloud users who participate in the W4 Games Early Access Program or who otherwise purchase or are authorized to use the product.      

 2. Information We Collect During the W4 Cloud Marketing Process and How We Protect It

This Section sets forth a brief summary of the information that we may collect during the W4 Cloud marketing and sales process and how we protect it. 

We may market W4 Cloud across multiple channels from time (such activity through such channels from time to time, the “W4 Cloud Marketing Process”), including through:

  • the W4 Games website and blog posts contained on that website;
  • our CRM platform on Odoo (the “CRM Platform”);
  • communication channels that we establish in our Early Access Program;
  • social media, such as Linkedin or Twitter;
  • conferences and other industry events;
  • in-person contacts with members of our team or third parties that we may work with.

Information that we may collect during the W4 Cloud Marketing Process includes, but is not limited to:

  • your name;
  • your contact information; 
  • information about your company; and
  • information about your company’s game. 

The protections regarding the information we collect during the W4 Cloud  Marketing Process are set forth in the W4 Games Privacy Policy, a copy of which is available on our website and can also be obtained from our Data Protection Officer. 

3. Information We Collect During the W4 Cloud Sales Process and How We Protect It

This Section sets forth a summary of information we collect during the W4 Cloud sales process and how we protect it.

Our primary sales channel for W4 Cloud is our CRM Portal which is on Odoo.  The information that we collect during that process and how we protect it is set forth in the W4 Games Privacy Policy.

On the CRM Portal we also collect information specifically related to W4 Cloud which is relevant to the determination of relevant pricing plan. 

4. Information We Collect During the Onboarding Process

This Section discusses information that we collect during the onboarding process and how we protect it.

Applicants for our Early Access Program must provide information that we request on a form.  This includes information about:

  • the applicant’s name
  • the applicant’s title
  • the applicant’s email
  • the company’s full legal name
  • project name
  • project description
  • project team size
  • project total budget
  • publisher’s name
  • estimated product launch date
  • the version of Godot currently being used
  • console port access that is requested
  • if NDAs have been signed with respect to consoles for which access is requested
  • console functionality that is requested
  • Godot features that are currently used in connection the project 
  • GitHub team member name, user name and email
  • applicant’s email address
  • applicant GitHub addresses.

Further information that we collect is set forth in our onboarding guides which are sent to successful applicants in our Early Access Program.

6. Additional Information Regarding Privacy Practices.

Additional information regarding our privacy policy regarding W4 Cloud is set forth in Addendum 1 to this W4 Cloud Privacy Policy.

7. Changes to Our Privacy Policy

In simple terms, this Section sets forth our right to make changes to our W4 Cloud Privacy Policy and how we will inform you if we do make changes.

We reserve the right to change this W4 Cloud Privacy Policy at any time. In the event that we make material changes to this W4 Cloud Privacy Policy, they will be re-posted in the "Privacy" section of our website with the date the modifications were made indicated at the top of the page.   When we make a material change to the W4 Cloud Privacy Policy, we will post notice of the change on our website.

Therefore, please check our website and review this W4 Cloud Privacy Policy from time to time so that you are aware when any changes are made to it. Your continued use of W4 Cloud after such change(s) constitutes your acceptance of any such change(s), and if you do not accept any changes, you may choose not to use W4 Cloud  or opt out by sending us appropriate notice. If you would like further information about any recent changes made, please send your request to privacy@w4games.com  include “Information about Changes” in the subject line.

8.  Legal Disclaimer

This Section sets forth certain legal disclaimers regarding our W4 Cloud Privacy Policy and your rights.

Our W4 Cloud service is provided as is, and we do not represent or warrant that W4 Cloud will be available at all times, or that your use of W4 Cloud will be uninterrupted or error-free. We are not responsible for your ability to access W4 Cloud or matters beyond our control. This W4 Cloud Privacy Policy is governed by the laws of the State of New York.  Any dispute arising from the use of the Services shall be submitted to the competent courts of New York for resolution.

Addendum 1 to Privacy Policy

Special Privacy Considerations

All users of the W4 Cloud service (“W4 Cloud”) should note that, as W4 Cloud is still in development, information used in connection with W4 Cloud may not be secure as information that will be stored in connection with fully developed products that have been issued for commercial release. Further, all users of W4 Cloud should only use W4 Cloud as part of their development process and should not publish the game.

All users of W4 Cloud use W4 Cloud at their own risk and the Company shall not be liable for breaches of information that occur during the development process. If potential or actual users have questions about data protection issues through the beta process of W4 Cloud, they should contact the W4 Games Data Protection Officer at privacy@w4games.com.

As W4 Cloud is based on the interaction of multiple parties, including game developers, game players, W4 Games Limited and third parties, this Addendum is designed to make clear how information is collected, stored and protected. W4 Games shall not be liable for breaches of data of third parties.
